After ruling two years ago the Noah's Ark replica being built in Williamstown, would not get a tax incentive, a federal judge ruled Monday to reverse the decision saying Kentucky officials violated the builders' First Amendment protections by blocking it from sales tax tourism incentives that could have been worth up to $18 million.

Answers for Genesis is building the Ark Encounter and it is expected to open in July. Former Governor Steve Beshear told the group they would be blocked from seeking the tax incentive because of the park's religious themes. The group opened the Creation Museum in Petersburg in 2007.

Govenor Matt Bevin said his office has no plans to appeal the Monday ruling.
